          Introduction

          Ankota, LLC ("Ankota" or "we" or "us" or "our") respects your privacy and is committed to protecting it through our compliance with this notice.

          This notice describes the types of information we may collect from you or that you may provide when you visit the websites and mobile applications https://www.ankota.com; https://www.ankotacares.com; https://4HomeCareHeroes.com; and https://evvgrader.com. Note that Ankota also has our software product available at https://ankota.net and has mobile applications including Ankota Caregiver and Ankota FMS that are covered by this privacy policy but also have additional protections (such as HIPAA). This additional privacy and security information is available to our customers. Collectively, this set of sites and apps is referred to for the remainder of this privacy policy as "the Websites and Apps."

          This notice applies to information we collect:

          • On the Websites and Apps.
          • In email, text, and other electronic messages between you and the Websites.

          It does not apply to information collected by:

          • Us offline or through any other means; or
          • Any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Websites.

          Please read this notice carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Websites. By accessing or using the Websites, you agree to this privacy notice. This notice may change from time to time (see Changes to Our Privacy Notice). Your continued use of the Websites after we make changes is deemed to be acceptance of those changes, so please check the notice periodically for updates.

          Important notices about the ownership of the data housed within our product and our apps:

          1. All data entered in the Ankota app is private and belongs to the individuals and organization who granted the user access to the app.
          2. Ankota's apps are developed following the principle of the "minimum necessary rule." This means that users are granted access to the minimum amount of data needed to perform their functions in the app. Otherwise stated, your data won't fall into the hands of people who don't need that specific data to perform their intended job within the system.
          3. Ankota is the custodian of the data in the apps, but doesn't own the data.

          Information We Collect About You and How We Collect It

          We collect several types of information from and about users of our Websites, including information:

          • By which you may be personally identified, such as name, postal address, e-mail address, telephone number, payment information, age, gender, sensory data, professional or employment information, education information, and inferences based on other data you provide to us ("personal information");
          • That is about you but individually does not identify you; and
          • About your internet connection, the equipment you use to access our Websites, and usage details.

          We collect this information:

          • Directly from you when you provide it to us.
          • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies.
          • From third parties, for example if we participated in a tradeshow that you attended and we were provided an attendees list from the tradeshow host.

          Information You Provide to Us

          The information we collect on or through our Websites may include:

          • Information that you provide by filling in forms on our Websites.
          • Records and copies of your correspondence (including email addresses), if you contact us.
          • Details of transactions you carry out through our Websites or for example, by clicking on an email that takes you to a page on our websites.
          • Your search queries on the Websites.

          Information We Collect Through Automatic Data Collection Technologies

          As you navigate through and interact with our Websites, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

          • Details of your visits to our Websites, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Websites.
          • Information about your computer and internet connection, including your IP address, operating system, and browser type.

          The information we collect automatically is only statistical data and does not include personal information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Websites and to deliver a better and more personalized service, including by enabling us to:

          • Estimate our audience size and usage patterns.
          • Store information about your preferences, allowing us to customize our Websites according to your individual interests.
          • Speed up your searches.
          • Recognize you when you return to our Websites.

          The technologies we use for this automatic data collection may include cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Websites. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Websites.

          • For any other purpose with your consent.

          Disclosure of Your Information

          We may disclose personal information that we collect or you provide as described in this privacy notice:

          • To partners who we collaborate with. For example, if you view one of our podcasts and click to learn more, we may share this with the podcast guest who you expressed interest in.
          • To our employees, contractors, or third parties we use to support our business.
          • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Ankota, LLC's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Ankota, LLC about users of our Websites is among the assets transferred.
          • To fulfill the purpose for which you provide it.
          • For any other purpose disclosed by us when you provide the information.
          • With your consent.

          We may also disclose your personal information:

          • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
          • To enforce or apply our Ankota Terms of Service and other agreements, including for billing and collection purposes.
          • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Ankota, LLC, our customers, or others.

          Choices About How We Use and Disclose Your Information

          We strive to provide you with choices regarding the personal information you provide to us. For example, if we received your information and we send you an email, you can unsubscribe from further emails. Additionally, you can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. Note that if you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

          Accessing and Correcting Your Information

          You can review and change your personal information by sending us an email at info@ankota.com to request access to, correct, or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

          Data Retention

          Ankota retains data collected through the Websites and Apps in accordance with the legal, regulatory, and contractual obligations applicable to that data. For data processed on behalf of our customers (home care agencies, adult day centers, I/DD providers, and self-direction/FMS programs), we treat all data as protected information regardless of whether it constitutes Protected Health Information (PHI) under HIPAA. Our standard retention period is seven (7) years from the date of last activity, consistent with HIPAA requirements, state Medicaid record retention rules, and the need to respond to lawful regulatory inquiries.

          For website visitors and marketing contacts, we retain data only as long as needed for the purpose for which it was collected, or until you request deletion. For automatically collected technical data (cookies, IP addresses, browser information), we retain this information for up to twenty-four (24) months.

          After data is deleted from our production systems, residual copies may remain in our backup systems for up to thirty (30) days, after which the data is permanently unrecoverable.

          Data Deletion

          You may request deletion of your personal data by contacting us at info@ankota.com. We will respond within thirty (30) days.

          Website visitors and marketing contacts may request deletion of any personal information provided through our Websites at any time.

          End users of our mobile applications (caregivers, direct support professionals, consumers, family members, and others with Ankota app accounts) should note that operational records created through the app, including visit records, time entries, care notes, and service documentation, are owned by the agency or organization that granted you access. Ankota acts as custodian of that data, not the owner, and cannot unilaterally delete operational records on an individual user's request. To request deletion of operational records, contact the agency or organization that granted you app access. You may, however, request deletion of personal account information not tied to operational records, such as personal contact details, profile photos, and authentication credentials, by emailing info@ankota.com.

          Customer organizations using Ankota's software platform may request deletion of bulk operational data prior to the end of the seven-year retention period. Because early deletion overrides the retention period that protects both parties against future audits, billing disputes, or regulatory inquiries, Ankota requires the requesting organization to execute a Data Destruction Agreement and Certificate of Destruction acknowledging the deletion is irreversible and accepting responsibility for any future need to access the deleted data. Upon execution and completion of deletion, Ankota is released from the corresponding retention obligations under the Business Associate Agreement.

          Notwithstanding the foregoing, Ankota shall not be required to destroy any Scope Data subject to an active litigation hold, subpoena, preservation obligation, regulatory investigation, or other legal requirement prohibiting destruction. 

          State Privacy Laws

          We do not meet the conditions as outlined in Section 1798.140 of the California Consumer Privacy Act of 2018 (the "CCPA") and therefore are not subject to CCPA requirements. We also do not meet the eligibility conditions outlined in the Virginia Consumer Data Protection Act, Colorado Privacy Act, Connecticut Data Privacy Act, or Utah Consumer Privacy Act and are therefore not subject to the requirements of these laws.           Data Security

          We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Despite these measures, we cannot 100% guarantee that data can't be breached because we host our website with a popular and reputable third party application (HubSpot) and no site can guarantee that there will never be a breach.

          Children Under the Age of 13

          Our Websites are not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Websites, register on the Websites, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use.
